Terms of Service Effective Date: August 2025 Acceptance of Terms By accessing or using Card-Era ("Card-Era," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, you may not use the platform. Description of Service Card-Era is an online marketplace that allows collectors to buy, sell, trade, and discuss sports cards, trading cards, and other approved collectibles. Card-Era provides a venue for users to connect and communicate but is not a party to transactions conducted between users. User Accounts To access certain features, users may be required to create an account. Users agree to: Provide accurate information Maintain the security of their account Keep login credentials confidential Notify Card-Era of any unauthorized account access Users are responsible for all activity conducted through their account. Seller Subscriptions Card-Era may offer paid seller subscriptions that allow users to create and maintain listings. Subscription fees are: Non-refundable except where required by law Subject to change with notice Required to maintain seller privileges Failure to maintain an active subscription may result in the removal or suspension of listing privileges. Marketplace Rules Users agree to: Accurately represent items for sale Use clear and honest descriptions Communicate respectfully with other users Complete transactions in good faith Follow all applicable laws and regulations Prohibited Activities The following activities are prohibited: Fraud or deceptive practices Selling counterfeit or unauthorized items Misrepresenting item condition or authenticity Harassment, abuse, or threats Spam or unsolicited advertising Creating multiple accounts to evade restrictions Attempting to interfere with platform operations Sharing malicious links or content Card-Era reserves the right to remove content and suspend accounts involved in prohibited activities. Transactions Between Users Card-Era does not buy, sell, own, inspect, store, ship, or take possession of items listed on the platform. All transactions are conducted directly between users. Users are solely responsible for: Evaluating trading partners Verifying item details Agreeing on payment methods Shipping arrangements Resolving transaction disputes Card-Era does not guarantee the completion or outcome of any transaction. Payments Card-Era does not process payments between buyers and sellers. Buyers and sellers are responsible for selecting and using their preferred payment methods. Card-Era recommends that users utilize payment methods that offer appropriate buyer and seller protections. User Content Users retain ownership of content they submit, including: Listings Images Reviews Messages Profile information By posting content on Card-Era, users grant Card-Era a non-exclusive license to display, distribute, and promote such content in connection with operating the platform. Reviews and Ratings Users may leave reviews and ratings based on legitimate marketplace interactions. Card-Era reserves the right to remove reviews that are: Fraudulent Abusive Misleading Irrelevant to marketplace activity Account Suspension and Termination Card-Era reserves the right to suspend, restrict, or terminate accounts at its sole discretion for violations of these Terms or conduct deemed harmful to the marketplace or its users. Termination may occur without prior notice in cases involving fraud, abuse, or security concerns. Disclaimer of Warranties Card-Era is provided on an "as-is" and "as-available" basis. Card-Era makes no guarantees regarding: Marketplace activity Transaction outcomes Item authenticity User conduct Continuous availability of the platform Use of the platform is at your own risk. Limitation of Liability To the maximum extent permitted by law, Card-Era, its owners, operators, affiliates, and service providers shall not be liable for: Transaction disputes Financial losses Shipping issues Misrepresentation by users Fraudulent activity by third parties Indirect, incidental, or consequential damages Card-Era's total liability shall not exceed the amount paid by a user to Card-Era during the twelve months preceding a claim. Indemnification Users agree to indemnify and hold harmless Card-Era and its operators from claims, liabilities, damages, losses, and expenses arising from: Use of the platform Violation of these Terms Transactions with other users User-submitted content Changes to the Service Card-Era reserves the right to modify, suspend, or discontinue any aspect of the platform at any time without liability. Changes to These Terms Card-Era may update these Terms from time to time. Updated Terms will be posted on the platform with a revised effective date. Continued use of Card-Era after changes become effective constitutes acceptance of the updated Terms. Governing Law These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Card-Era operates, without regard to conflict of law principles.
